Welcome to Fancyber, a social utility that connects you with the people around you. The Fancyber service and network (collectively, "Fancyber" or "the Service") are operated by Fancyber, Inc. and its corporate affiliates (collectively, "us", "we" or "the Company"). By accessing or using our web site at Fancyber or the mobile version thereof (together the "Site") or by posting a Share Post Button on your site, you (the "User") signify that you have read, understand and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement"), whether or not you are a registered member of Fancyber. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Service or the Site after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Service or the Site. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.

 

Basic Terms

  • You must be 13 years or older to use this site.
  • You are responsible for any activity that occurs under your user name.
  • You are responsible for keeping your password secure.
  • You must not abuse, harass, threaten, impersonate or intimidate other users.
  • You may not use this service for any illegal or unauthorized purpose.
  • You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos,
    profiles, audio and video clips, links (“Content”) that you submit, post, and display on the Fancyber service.
  • You must not modify, adapt or hack Fancyber or modify another website so as to falsely imply that it is associated with Fancyber.
  • You must not create or submit unwanted email to any Fancyber members (“Spam”).
  • You must not transmit any worms or viruses or any code of a destructive nature.
  • You must not, in the use of Fancyber, violate any laws in your jurisdiction (including but not limited to copyright laws).

Violation of any of these agreements will result in the termination of your Fancyber account. While Fancyber prohibits such conduct and content on its site, you understand and agree that Fancyber cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the Fancyber service at your own risk.

 

General Conditions

  • We reserve the right to modify or terminate the Fancyber service for any reason, without notice at any time.
  • We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via internet mail according to the preference expressed on your account. What constitutes a “material change” will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
  • We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
  • We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms.
  • The Fancyber service makes it possible to post images and text hosted on Fancyber to outside websites. This use is accepted (and even encouraged!). However, pages on other websites which display data hosted on Fancyber must provide a link back to Fancyber.
  • We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.

Fancyber uses cookies and other similar technologies, such as pixels or local storage, to help provide you with a better, faster, and safer experience. Here are some of the ways that the Fancyber services — including our various websites, SMS, APIs, email notifications, applications, buttons, widgets, and ads — use these technologies: to log you into Fancyber, save your preferences, personalize the content you see, protect against spam and abuse, and show you more relevant ads.

                    For example, these technologies help authenticate your access to Fancyber and prevent unauthorized parties from access.
                    They also let us show you appropriate content through our services. 

 

  • Preferences:

                    For example, cookies help us remember your preferred language or country that you are in.
                    We can then provide you with Fancyber content in your preferred language without having to ask you each time you visit Fancyber.
                    We can also customize content based on your country, such as showing you what topics are trending near you, or to withhold
                    certain content based on applicable local laws - for mobile website and app only.

 

  • Analytics and Research:

                    For example, cookies help us test different versions of our services to see which particular features or content users prefer.

Where are these technologies used?

Fancyber and third parties use these technologies on Fancyber's websites, applications, and services and on other websites, applications, and services that have integrated Fancyber's services, including third-party properties that incorporate Fancyber's advertising technology. This includes our ad partners’ websites and sites that use Fancyber buttons or widgets, like our post or add friend buttons. Third parties may also use these technologies, for example, when you click on links from Fancyber websites or applications, view or interact with third-party content from within our services, or visit third-party websites that incorporate Fancyber's advertising technology.

Our services instantly connect people everywhere to what’s most meaningful to them. Any registered user of the Fancyber Services can send a status messages, which is a message of 10,000 characters or less that is public by default and can include other content like photos, videos, and links to other websites.

This Privacy Policy (“Policy”) describes how and when Fancyber collects, uses and shares your information when you use our Services. Fancyber receives your information through our various websites, SMS, APIs, email notifications, applications, buttons, widgets, ads, commerce services (the “Fancyber Services”), and our other covered services that link to this Policy (collectively, the “Services”) and from our partners and other third parties. For example, you send us information when you use our Services on the web, via SMS, or from an application such as Fancyber for Web Version, Fancyber for Android or Fancyber for iOS. When using any of our Services you consent to the collection, transfer, storage, disclosure, and use of your information as described in this Privacy Policy.

 

Information Collection and Use

Basic Account Information: When you create or reconfigure an account, you provide some personal information, such as your name, username, password, email address, or phone number. On the Fancyber Services, your name and username are listed publicly, including on your profile page and in search results, and you can use either your real name or a pseudonym. Some Fancyber Services, such as searching and viewing public user profiles, do not require registration.

Contact Information: You may use your contact information, such as your email address or phone number, to customize your account or enable Services. If you provide Fancyber with your phone number, you agree to receive text messages to that number from Fancyber. When you use E-mail address / usernames to sign up for or login to a third-party application, you are directing Fancyber to share your contact information, such as your phone number, with that application. We may use your contact information to send you information about our Services, to market to you, to help prevent spam, fraud, or abuse, and to help others find your account, including through third-party services and client applications. You may use your settings for email and mobile notifications to control notifications you receive from the Fancyber Services. You may also unsubscribe from a notification by following the instructions contained within the notification or the instructions on our website. Your privacy settings control whether others can find you on the Fancyber Services by your email address.

Additional Information: You may provide us with profile information / profile question to make public on the Fancyber Services, such as a tagline, your country, your careers, your education background, date of birth, or a picture. For certain profile information fields we provide you with visibility settings to select who can see this information in your profile. If you provide us with profile information and you don’t see a visibility setting, that information is public. You may choose to upload and sync your address book so that we can help you find and connect with users you know or help other users find and connect with you. We may later tailor content, such as making suggestions or showing user accounts and other users based on imported address book contacts. You can delete your imported address book contacts at any time. Learn more here. If you email us, we may keep your message, email address and contact information to respond to your request. This information enables cross-posting, helps us improve the Services, and is deleted from our Services within a few weeks of your disconnecting from our Services your account on the other service.
